vertex terms of use.
These are the terms for using vertex, my free terminal coding assistant for Apple silicon Macs. The portfolio site and the Nexus AI Terminal are covered by the umbrella terms of use, and Nexus has its own expanded terms.
Plain English. If something is ambiguous, the spirit of the rule wins over the exact wording. If you really need the exact wording, email me.
Who I am
Xavier Scott, sole operator. Contact: xavier@thyfwxit.com. No company, no team. These terms are between you (the user) and me.
Using vertex
These terms also cover vertex, a compiled program for Apple silicon Macs running macOS 11 or newer, downloaded from this site or installed with curl -fsSL https://thyfwxit.com/vertex/install.sh | sh, which checks the download against its published checksum. Its source code is not published.
You may install and use vertex for free, for personal or work projects, on your own Macs. Please don't redistribute or resell the program itself; link people to /vertex/ instead, so they always get the current, checked version.
vertex reaches AI models with your own API key or through a Nexus server you sign in to. The provider's or server's own terms and privacy policy apply to what it receives, and you are responsible for any charges on your own provider account. Only send prompts, code and files you have the right to share with them. Someone who runs a Nexus server can see and log what passes through it, and I can revoke access keys to my own server at any time.
vertex can read, change and run code in the folder you start it in. Commands it runs go through the macOS sandbox, with no network and writes only inside that folder, but you approve the changes and you are responsible for what you run and keep. AI output can be wrong: review code and commands before you rely on them, and keep backups or version control for anything that matters.
No warranty
vertex is provided as is, with no warranty of any kind, express or implied. I do my best to keep things working and accurate, but I make no guarantee of uptime, accuracy, or fitness for any particular purpose.
Liability
To the maximum extent allowed by law, I am not liable for any damages, direct, indirect, incidental, consequential, or otherwise, arising out of your use of vertex. If you find that unreasonable, do not use vertex.
If I am found liable anyway, my total liability to you for all claims about this site, vertex, or how I handle the information described in my privacy policy is limited to the greater of 50 US dollars or what you paid me to use them. This is one combined limit, the same one stated in the privacy policy. Neither this cap nor the exclusion above limits anything the law does not let me limit.
Indemnification
To the extent the law allows, you agree to cover losses and reasonable legal costs I face from a third party claim caused by your unlawful use of this site or vertex, or by content you sent through them without the right to. This does not cover losses caused by my own negligence or misconduct. I will tell you promptly about such a claim and cooperate reasonably in its defense.
Deleting your data
You can ask me to delete the vertex records my Nexus server keeps about you by emailing me. What I keep and how deletion works is in the vertex privacy policy. Files vertex keeps on your own Mac are yours to delete at any time.
Changes to these terms
If these terms change materially, I update the "Last updated" date at the top of this page. Continued use of vertex after a change means you accept the updated terms.
Governing law
I am based in the United States. These terms are governed by U.S. law. Any dispute will be resolved in U.S. courts to the extent permissible.
